General terms and conditions

1. Scope

The following terms and conditions apply to all orders from our online shop. Our online shop is aimed exclusively for consumers.
A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity.

2. Purchase contract, Ordering process

2.1 The purchase contract is closed with GbR Mirjana Filipovic und Ivan Filipovic.

2.2 The customer places the desired product or products in a virtual shopping cart without purchase obligation. The customer then clicks on the “Checkout” button to view the virtual shopping cart and has to enter his email address, delivery address, desired shipping method and payment method in the input fields provided in order to continue the ordering process. By clicking on the “Place order” button, the customer completes the ordering process and sends an offer to purchase the goods in the virtual shopping cart to GbR Mirjana Filipovic und Ivan Filipovic. Immediately after submitting his order the customer receives a confirmation of receipt of the order by email.

3. Contract language, Contract text storage

3.1 The language (s) available for the conclusion of the contract: German and English.

3.2 We do not save the full text of the contract. Before sending the order via the online shopping cart system, the contract data can be printed out or electronically saved using the browser’s print function. After we have received the order, the order data, the information required by law for distance sales contracts and the general terms and conditions will be sent to you again by email.

4. Payment Methods

The following payment methods are generally available in our shop:

5. Discount code

Our online-shop reserves the full right to use discount codes. If customers violate the code rules, we have the right to cancel the order or forfeit the payment. The rules for discount codes are listed below:

(1) Discount codes, including but not limited to the forms of percentage, value, free gifts, and free shipping, may only be used once by each customer.

(2) Customers must not benefit from the discount code by selling the codes to other customers or for other fraudulent purposes.

6. Delivery terms

Delivery takes place within 2 working days to the delivery address specified by the customer.

The prices stated at our online-shop are final prices including sales tax. The amount that is shown at the time of the binding order applies. If the shipment is sent outside the EU, it may be subject to import duties and taxes levied once the package arrives at the designated destination. Customs fees must be borne by the buyer.

7. Transport damages

The risk of accidental loss and accidental deterioration is transferred to you as soon as we have delivered the item to the freight forwarder, the carrier or the person or institution otherwise assigned to carry out the shipment. The duty of inspection and notification of defects regulated in Section 377 of the German Commercial Code (HGB) applies to traders. If you omit the notification regulated there, the goods are considered approved, unless there is a defect that was not recognizable during the examination. This does not apply if we have fraudulently concealed a defect.

8. Warranty

In the event of defects in the delivered product the customer is entitled to the statutory warranty rights (according to German law).

9. Refund policy

All items purchased through our website can be returned within a maximum of 14 calendar days from the date of receipt of the product.

9.1 Returns and Refunds
For a refund to be accepted, the returned item must be in the same condition as when you received it. This means:
– the item must be unused and undamaged
– the attached labels or tags must not be removed
– the item must be in the original packaging

9.2 Return and refund process
To make a return, write to us using our contact form or email info@falle-sports.comwhich product you would like to return (invoice number, product code, product reference, product description, quantity, size …).
Pack the item in the original packaging and send it to the address we will provide to you upon receipt of your refund request. We recommend you to save the proof of shipment.
The costs and risks associated with returns are borne exclusively by the buyer.
As soon as we receive your returned item, we will send you a confirmation email. If your refund is approved, we will issue a refund to the original payment method. The original shipping costs will not be refunded.
Please note that there can be up to 15 working days between receipt of the confirmation email and the refund, depending on the conditions of the respective bank.

9.3 Exchanges
If you want to exchange an item, you need to return already received article and make a new order with the product you want.

10. Reclamation

You order has arrived damaged, the delivery is incomplete, or you received the wrong article? We are very sorry! We will take care of your request as soon as possible.
Call us or write to us via our contact form or send an email to info@falle-sports.com with a brief description of the damage and the corresponding photos of the item.

11. Applicable Law

The contract concluded between you and GbR Mirjana Filipovic and Ivan Filipovic is exclusively subject to the law of the Federal Republic of Germany with the express exclusion of the UN sales law. This does not affect the mandatory provisions of the state in which you have your habitual residence.

12. Place of jurisdiction

If, contrary to your information when ordering, you do not have a place of residence in the Federal Republic of Germany or if you move your place of residence abroad after signing the contract or if your place of residence is unknown at the time the action is brought, the place of jurisdiction for all disputes arising from and in connection with the contractual relationship is Mannheim Germany.

13. Dispute resolution

General information obligations for alternative dispute resolution according to Art. 14 Para. 1 ODR-VO and § 36 VSBG (Consumer Dispute Settlement Act):
The European Commission provides a platform for online dispute resolution (OS), which you can find at this address: http://ec.europa.eu/consumers/odr/. We are neither obliged nor willing to participate in a dispute settlement procedure before a consumer arbitration board.

14. Final provisions

14.1 Should individual provisions of this contract be or become wholly or partially ineffective or void, this shall not affect the validity of the rest of the contract, insofar as a contractual partner is not unreasonably disadvantaged.

14.2 Changes or additions to this contract must be made in writing.
